”US THE DUO HELLO LAB” CONTEST (“Contest”)
NO PURCHASE NECESSARY TO PARTICIPATE OR RECEIVE PRIZES. PURCHASE OR ACCEPTANCE OF A PRODUCT OFFER DOES NOT IMPROVE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. PARTICIPATION IN THE CONTEST IS VOID WHERE PROHIBITED. BY ENTERING THE CONTEST, ENTRANTS AGREE TO BE BOUND BY THESE OFFICIAL RULES.
Eligibility: The Contest is open only to anyone who at the time of entry is: (a) over the age of 13, and (b) a registered user of the applicable Platforms on which the Entries may be submitted. All entrants under the age of 18 must have written consent from their parents or guardians to enter the Contest and be bound by these Official Rules. Entrants are required to have Internet access and an active e-mail account in order to participate. The following individuals are not eligible to participate in the Contest: (i) employees, officers and directors of the Fullscreen (“Sponsor”), AT&T Mobility LLC (“AT&T”) and their respective parent companies, affiliates, and subsidiaries; and (ii) Immediate Family members (as defined below) of any of the foregoing.
For the purpose of these Official Rules, the term “Immediate Family” shall mean husband, wife, spouse, mother, father, brother, sister, son and/or daughter, whether or not they reside in the same household.
Promotion Timing: The Contest begins at approximately 12:01am ET on July 27, 2016 and ends at 11:59pm ET on December 31, 2016 (“Contest Period”).
How To Enter: During the Contest Period, (a) visit publicrecordep.com (“Contest Website”) and read these Official Rules, and (b) submit a story about your own interesting or unique life experiences that complies with the Submission Requirements (as defined below) (each an “Entry”) on either the Contest Website or any of the following platforms: Facebook, Instagram, Twitter, Tumblr, YouTube, and Vine (collectively “Platforms”). The Entry can be of video or written form. Pictures can be included as supplemental materials to written or verbal story. Selected Entries to be used as part of Public Record Project including, but not limited to: casting to select final participants, musical inspiration for Us The Duo songs, inspiration for video materials, inclusion in final series, promos or social media posting on all mediums and platforms worldwide.
**By entering the Contest, entrants agree to be bound by these Official Rules. In the event of a dispute regarding any aspect of the Contest, the Sponsor will make the final ruling in their sole discretion. Such ruling shall be final and binding, and no communication or correspondence will be exchanged with entrants regarding such ruling(s) unless otherwise required by law.
Sponsor reserves the right, in its sole discretion, to immediately disqualify, without notice, any and all Entries that do not comply with the Submission Requirements set out above, as determined in the Sponsor’s sole discretion. Entries shall not be returned to the entrant for any reason.
Entries shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the Entry (i.e., the natural person who is assigned to an e-mail address by an Internet service provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address). A potential winner may be required to provide the Sponsor with proof that she/he is the authorized account holder of the e-mail address associated with the potential winning Entry.
Submission Requirements: In order to be eligible, the Entry must meet the following requirements (collectively, the “Submission Requirements”):
The Entry shall include the required elements as communicated by Us The Duo (“UTD”) in the AT&T Hello Lab (“Hello Lab”) call to action video that can be found at http://www.youtube.com/user/MichaelAlvaradoMusic.
The Entry shall be in English.
The Entry shall include the hashtag “#publicrecordep” and be sent as a reply to @atthellolab and/or @UsTheDuo across the applicable Platforms.
The Entry must not contain offensive, profane, vulgar, obscene or inappropriate language.
The Entry must not contain third party materials, or otherwise violate or infringe any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity.
The Entry must not contain any references to alcoholic beverages, tobacco, drug paraphernalia, firearms, unlawful activities or materials.
The Entry must not contain defamatory, libelous, or slanderous content.
The Entry must not contain content that engages in, encourages, advocates, discusses with the intent to commit, or provides instructions for conduct that would constitute a criminal or civil offense or would otherwise violate any federal, state, local or international law or rule.
The Entry must not contain material or content that is, or may reasonably be considered to be, hate speech, whether directed at an individual or group, and whether based upon the race, sex, creed, national origin, religious affiliation, marital status, sexual orientation, gender identity, or language of such individual or group or that is otherwise unlawfully threatening or unlawfully harassing to any individual, partnership, corporation, or political body.
The Entry must not contain material or content for which you were compensated or granted any consideration by any third party.
Winner Selection and Notification: Each eligible Entry will be judged by a panel of Sponsor-selected judges, based on the following judging criteria: (a) adherence to the Submission Requirements; and (b) emotional impact of the Entry. Subject to each entrant’s compliance with these Official Rules and the Submission Requirements, the entries receiving the highest scores will be selected as the winners. In the event of a tie, the Sponsor, in its sole and professional judgment, will select the winners. The winners will be notified via email as soon as reasonably practicable after the judges have selected the winners. By participating in the Contest, you agree that the results of the Contest are final and binding in all respects. As a condition to being selected as a winner, each potential winner may be required to submit to background checks and or other verification processes as well as provide supporting documents (such as a copy of the winner’s driver’s license) in form and substance satisfactory to Sponsor in furtherance of the representations, warranties and covenants set forth in these Official Rules.
Prize: Up to one hundred (100) winning Entries will be (a) used to create music for an EP by UTD, and/or (b) recognized by UTD via in person visits, videoconference calls, or similar communication with such winning entrants (the “Prize”). No monetary value is associated with the Prize. The Prize must be accepted as awarded and cannot be transferred, assigned, or substituted for cash, except at the sole discretion of the Sponsor.
Conditions: Neither the Sponsor, AT&T, the Platforms nor their respective parent companies, affiliates and/or subsidiaries, are responsible for printing, clerical or typographical errors of any kind or nature relating to Entries. In no event will the Sponsor be obligated to award more than the stated number of prizes. Except for the Prize, entrants agree that neither the Sponsor nor its respective parent companies, affiliates and/or subsidiaries shall be obligated to publish or otherwise exploit any Entry in any manner. Entrants agree that the Sponsor, AT&T, the Platforms, and each of their respective parent companies, subsidiaries, affiliates, agents and promotional agencies shall not be liable for negligence, gross negligence, damages, injuries or losses of any kind resulting in whole or in part from participation in the Contest, or from acceptance, use or misuse of any prize, except that which cannot otherwise be excluded by law. By participating in the Contest, entrants agree to indemnify the Sponsor, AT&T, the Platforms, and each of their respective parent companies, subsidiaries, affiliates, agents and promotional agencies from any claims incurred as a result of such damages, injuries and losses. Neither the Sponsor, AT&T, the Platforms nor their respective parent companies, affiliates and/or subsidiaries assume any liability for lost, late, incomplete, inaccurate, undeliverable or misdirected entries, notifications and/or responses, or for any computer, online, software, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an Entry. Entrants are responsible for all costs associated with participation in the Contest, including but not limited to computer equipment and internet connection charges. Neither the Sponsor, AT&T, the Platforms nor their respective parent companies, affiliates and/or subsidiaries are responsible for damage to any participant’s computer system/software related to or resulting from participation in the Contest. Neither the Sponsor, AT&T, the Platforms nor their respective parent companies, affiliates and/or subsidiaries assume any responsibility or liability in the event that the Contest cannot be conducted as planned for any reason whatsoever, including but not limited to reasons beyond the control of the Sponsor, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes outside the control of the Sponsor which impairs or affects the administration, security, fairness, integrity, or proper conduct of the Contest. Sponsor reserves the right, in their sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest. The Contest and these Official Rules are void, in whole or part, where prohibited by law and is subject to all applicable laws and regulations.
By participating in the Contest, each entrant represents and warrants that: (i) the Entry is original to the entrant, and all right, title and interest (including but not limited to copyright) therein and thereto is exclusively owned and/or controlled by the entrant to the full extent necessary to enable the Sponsor to use the Entry as contemplated by these Official Rules; (ii) the Entry does not contain any material that is libelous, defamatory, profane or obscene, as determined by the Sponsor in their sole discretion; (iii) the Entry does not contain any material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; (iv) the Entry does not contain any material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where the Entry is created; (v) the Entry does not infringe upon the intellectual property or other statutory or common law rights of any third party (including but not limited to copyright, trademark, personality or privacy rights); (vi) the Sponsor’s use and re-use of the Entry in accordance with the terms set out herein will not infringe or violate the rights of any third party (including copyright), or require any payment to or consent/permission from any third party; and (vii) the Entry has not been previously exploited or published in any form (including being self-published), and no rights in or to the Entry have been granted, pledged, or assigned to any third party which would interfere with or derogate from the rights granted to the Sponsor hereunder.
Each entrant grants to Sponsor a worldwide, royalty-free, perpetual, irrevocable, non-exclusive right and license to publish, copy, distribute, and display each submitted Entry, in any media, and with right to use, broadcast, translate, adapt, copy, modify, edit, and create derivative works there from, and agrees to execute documents confirming such right and license. By entering, you understand that your Entry (or portion thereof) may be posted online, in Sponsor’s sole discretion, to be viewed by members of the general public. Entrants may not copy or otherwise plagiarize any portion of the Entry from any source. Without limitation of the foregoing, submission of an Entry constitutes your agreement that Sponsor and its parent companies, subsidiaries, and affiliates are permitted (but are not obligated) to display the Entry online (whether on web pages, applications or on third party web pages or applications), to incorporate the Entry in online and offline promotional advertising, marketing, and/or other commercial materials, and to reproduce, adapt and distribute the Entry in all media whether now known or later developed. In addition, you hereby assign to the Sponsor all rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the Entry. You waive any right to inspect or approve uses of the Entry or to be compensated for any such uses.
Entrants, as a condition of entry into the Contest, agree to release and discharge Sponsor, AT&T, the Platforms, and each of their respective parent companies, subsidiaries and affiliates, and each of their respective employees, directors, officers, suppliers, agents, sponsor and administrators (collectively, the “Released Parties”) from any and all liability, claims, suits, actions, and demands for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any contest-related activity or the acceptance of any prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising there from. By participating in the Contest, you agree that the Released Parties will have no liability whatsoever for, and will be held harmless by you for any liability for any bodily injury, loss, cost or damages of any kind to persons, including death and property, damages sustained due in whole or in part, directly or indirectly, from your Entry creation or participation in the Contest or participation in any Contest or related activity.
Privacy and Use of Personal Information: By participating in the Contest, each entrant grants to the Sponsor and its parent companies, affiliates and/or subsidiaries, the right to use his/her name, photograph, mailing address, telephone number, and e-mail address (collectively, “Personal Information”) as follows: (i) for the purpose of administering the Contest, including but not limited to contacting and announcing the winner; and (ii) for publicity and promotional purposes relating to the Contest, UTD or Hello Lab, in any and all media now known or hereafter devised, without further compensation unless prohibited by law, such use shall only be with respect to the entrant’s name, city and country, state, province or territory of residence. The Sponsor and their respective parent companies, affiliates and/or subsidiaries will use the entrant’s Personal Information only for identified purposes, and will protect the entrant’s Personal Information in a manner that is consistent with the respective privacy policies of Sponsor (www.fullscreen.com/legal) and the respective Platforms.
Termination: Subject to any governmental approval which may be required, the Sponsor reserve the right to terminate or suspend the Contest, in whole or in part, and/or amend the Official Rules in any way, at any time, for any reason, without prior notice.
Amendments to Official Rules: Any amendments to the Official Rules will become binding upon all entrants at the time they are posted to the Contest Website. Entrants are advised to regularly check the Contest Website for updates, notices and revisions to the Official Rules during the applicable Contest Period.
Disputes; Governing Law: Any and all disputes will be resolved in the appropriate courts in the State of California, exclusively, and subject to the laws of the State of California. Should there be a conflict between the laws of the State of California and any other laws, the conflict will be resolved in favor of the laws of the State of California.
Winners List: Each winner’s name and/or Platform username or handle will be posted to the Contest Website for at least one (1) month after such winner has been determined.
